END USER LICENCE AGREEMENT (EULA)
M4k Optimizer · Last updated: 25 October 2026
IMPORTANT: read carefully before installing. By installing or using M4k Optimizer ("the Software") you accept this agreement in full. If you do not accept it, do not install the Software.
1. PROVIDER
The Software is distributed by Martin Faraglia ("the Provider").
VAT number (Italy): IT02828730222
Contact: supporto@m4ktweaks.com
2. SCOPE OF THE LICENCE
The Provider grants you a personal, non-exclusive, non-transferable licence to use the Software. The Software is licensed, not sold.
The Software has three plans, determined by the roles of your Discord account in the M4k Discord server:
- Unverified: you have not signed in with Discord, or your account is not in the server or does not have the "utente" (user) role. Changes already applied can always be undone, but no new ones can be applied.
- Free: your account has the "utente" role, which the server gives to everyone who joins. It unlocks the free features.
- PRO: your account has the "premium" role, granted with the subscription (section 7). It unlocks all features, on ONE computer per account at a time. To switch computer you transfer PRO to it from the Software (once every 30 days), or wait 7 days without using the previous computer.
By signing in with Discord in the Software you agree to join the M4k Discord server, where you receive the "utente" role; staying in the server is a condition for using the Free and PRO plans. The server has its own rules: leaving the server, being removed or being banned for breaking the rules puts the Software back on the Unverified plan, without undoing the changes of free features already applied, which you can undo at any time. The PRO subscription can still be cancelled at any time from Polar's customer portal (section 7). Being banned from the server for breaking the community's rules or guidelines means losing the PRO plan without a refund of the period already paid for, without prejudice to the mandatory rights granted to consumers by law.
When the subscription expires or is revoked, PRO features are disabled: the system changes applied by PRO features are undone and the related settings return to the values they had before they were applied. This happens at the first online check after expiry, or immediately if you sign out of your account in the Software. The automatic game mode and "Game first" are switched off at the same moment; if a match is in progress, they stay on until that game is closed, so that the match is not interrupted. Game configurations already applied remain in the games' files, and you can restore the original ones at any time, even without a subscription. If the subscription is renewed, the undone changes are re-applied automatically.
You may not: resell, rent or share your account or your access to the subscription with others; decompile, disassemble or modify the Software; or circumvent its protection or subscription verification mechanisms.
3. NATURE OF THE SOFTWARE — PLEASE READ
The Software modifies Windows system settings and requires administrator privileges. It may change: the system registry, power plans, Windows services, network and DNS settings, boot configuration (BCD), device state in Device Manager, graphics driver settings and profiles, Windows security settings and game configuration files. Changes apply to the Windows account under which the Software runs as administrator.
The Software creates a backup of the values it changes and allows them to be restored. Switching a change off in the Software returns the setting to the Windows default or, where that differs from system to system, to the value it had before. Uninstalling undoes the changes applied by the Software, restoring the values that were present before they were applied.
FEATURES THAT REDUCE SECURITY PROTECTIONS. Some advanced features, always preceded by an explicit confirmation prompt, switch off Windows protections. In particular, "Disable Memory Integrity (HVCI)" reduces the isolation of system drivers and can prevent access to games whose anti-cheat systems require it (for example Valorant and FACEIT). You enable them knowingly and at your own responsibility.
OPERATIONS THAT CANNOT BE UNDONE BY THE SOFTWARE. The following operations are NOT undone automatically, neither by the Software nor by uninstalling it:
- a) "Remove Pre-Installed Apps" (preceded by an explicit confirmation): uninstalls Windows applications. They can only be restored manually via the Microsoft Store.
- b) "Disable BitLocker" (preceded by an explicit confirmation): starts decryption of the system drive. Re-enabling it requires a full re-encryption, to be performed manually from Windows settings.
- c) The repairs in the "Fix & Repair" section (for example the Windows network reset): they are one-off interventions.
- d) Applications installed from the "Microsoft Store" section (see section 4).
You are expected to create a system restore point before applying advanced changes. The Software provides this function in the "Safety Center" section. Keeping an up-to-date backup of your data is also strongly recommended.
4. INSTALLING THIRD-PARTY APPLICATIONS (MICROSOFT STORE)
The "Microsoft Store" section lets you search for free applications and install them through winget, Microsoft's installation tool. By pressing "Install" you request the installation of the chosen application and accept the Microsoft Store terms and that application's licence terms, which the Software accepts on your behalf. Installed applications are third-party products subject to their own terms: the Provider is not responsible for them and does not warrant that they work. Installed applications remain on the system after the Software is uninstalled.
5. YOUR RESPONSIBILITY
You use the Software at your own risk and acknowledge that its optimizations act on system components. You are responsible for assessing whether the changes are appropriate for your hardware and software configuration, and for complying with the rules of the games and services you use.
6. WARRANTY AND LIMITATION OF LIABILITY
The Software is provided "as is", with no guarantee of results. The Provider does not warrant that the Software is error-free, nor that it will deliver any specific performance improvement, which depends on each individual system.
To the maximum extent permitted by applicable law, the Provider shall not be liable for indirect damages, loss of data, loss of profit or business interruption arising from use of the Software. In any case the Provider's total liability shall not exceed the amount paid by you in the twelve months preceding the event.
Nothing in this agreement excludes or limits liability for wilful misconduct or gross negligence, nor any mandatory consumer rights granted by applicable law.
7. SUBSCRIPTION, RENEWAL AND WITHDRAWAL
The subscription is purchased through Polar (Polar Software, Inc.), which acts as reseller: it collects the payment, applies the taxes due, issues receipts and handles refunds and disputes under its own terms, which you accept at purchase. After paying you link your Discord account and receive the "premium" role in the M4k Discord server; signing in to the Software with the same account turns PRO features on.
The subscription renews according to the billing period chosen at purchase (monthly or yearly) and may be cancelled at any time from Polar's customer portal; cancellation takes effect at the end of the period already paid for, after which the "premium" role is removed.
Consumers (EU): the 14-day right of withdrawal applies as provided by law. As this is digital content supplied immediately, the right of withdrawal is lost once immediate performance has been requested and accepted by you at purchase.
8. PERSONAL DATA AND NETWORK CONNECTIONS
The Software contains no telemetry of its own: it collects no browsing data and no usage data for statistical or advertising purposes. It connects to external services only in the following cases, and each of them, like any Internet connection, also receives your IP address:
- Sign-in and plan check (the Provider's service, hosted by Cloudflare): at sign-in, at every start and about every six hours. You sign in on Discord's website, which gives the service only the account's identifier and name (not your email address or password) and, with the permission you grant, lets it add the account to the M4k Discord server; the service then checks through Discord the account's roles in the server ("utente", "premium"). The Discord account's identifier and name, a hashed identifier of the computer (pseudonymised data, not the computer's or the user's name) and the date of last use are kept, to enforce the per-account computer limit. For subscribers, the service also receives from Polar the list of Discord accounts with an active subscription and their Polar customer code, to give the "premium" role back to anyone who leaves the Discord server and rejoins it. This data is deleted on request.
- Payments (Polar): payment and billing data is collected and processed by Polar under its own privacy policy; the Provider never receives card details. If you buy with a creator's code, the Provider records the date and amount of your subscription's payments and the codes Polar uses for you and the subscription (never your name or email), to work out the creator's commission; the creator only sees totals.
- Update check (GitHub): one request to find out whether a newer version exists.
- "Microsoft Store" section, only when it is opened: the search text, country and language are sent to Microsoft's catalogue; installations go through winget, which contacts Microsoft and the applications' publishers.
- Network tests (DNS and Bufferbloat), only at your request: traffic towards public measurement services (Cloudflare, Google, Quad9).
The data needed to work (backups of the settings, the encrypted account session, the last plan check, the event log of the last 14 days) stays on your computer. The event log is not sent anywhere: you may share it voluntarily with support.
To exercise your rights under Regulation (EU) 2016/679 (access, rectification, erasure, objection) you can write to the contact given in section 1.
9. THIRD-PARTY COMPONENTS
The Software includes third-party components subject to their own licences, listed in the THIRD-PARTY-NOTICES.txt file located in the installation folder. For those components, their licences prevail over this agreement.
Setup additionally installs PawnIO (https://pawnio.eu/), a third-party system component required to read CPU temperature sensors. It is installed separately via its official, signed and unmodified installer, and appears under Windows "Installed apps" as its own entry. Because it is a shared component that other software already on the system may also rely on, it is NOT removed when M4k
Optimizer is uninstalled: it can be removed by the user from Windows settings.
Third-party trademarks. Fortnite, VALORANT, Counter-Strike 2, Apex Legends, Call of Duty and the other game names mentioned in the Software are trademarks of their respective owners, used only to identify the games the Software's features apply to. The game icons the Software shows are read from the games installed on your computer and are not distributed with the Software. M4k is an independent product, not affiliated with or endorsed by Epic Games, Riot Games, Valve, Electronic Arts or Activision.
10. TERM AND TERMINATION
This licence is effective until terminated. The Provider may terminate it in the event of a material breach of this agreement. Upon termination you must stop using the Software and uninstall it.
11. GOVERNING LAW AND JURISDICTION
This agreement is governed by Italian law. Disputes shall be subject to the jurisdiction of the courts where the Provider has its registered office, without prejudice to any mandatory consumer jurisdiction where applicable.
